Pierce J. Schultz

Overview

Pierce Schultz joined Jimerson Birr in May 2020 as a Summer Associate. Due to the coronavirus pandemic, he has been able to continue working for the firm while he completes the final year of his J.D. remotely with the University of Florida.

Pierce is currently studying on the highest scholarship offered by UF Law; is ranked in the top 5% of his class of 283 students; has earned book awards in Legal Writing, Legal Research, Florida Administrative Law, and Condominium and Community Development Law; and recently published an article effectively resolving a circuit split in a scholarly legal journal.

Pierce resides on the South Bank with his wife, Debra, and their son, Micah. Although Pierce has lived in Texas, Kentucky, Ohio, New York, Connecticut, Massachusetts, and New Hampshire, he is Floridian through and through. When he is not reading and writing, you can usually find him stalking redfish in the marsh. He also enjoys other types of saltwater fishing, playing guitar, chess, basketball, and collecting coins.

Representative Matters
Creditors’ Rights and Commercial Collections
- Drafted a complaint for replevin and a motion for an ex parte prejudgment writ of replevin on a motorcycle, which was granted.
Business Litigation
- Drafted a motion for an ex parte prejudgment writ of replevin, which was granted, on a truck worth over $300,000 that was being withheld under an improper mechanic’s lien.
- Drafted a motion for partial summary judgment on liability against a landscaper, which ultimately led to a mediated settlement.
- Analyzed several issues in a consumer class action that helped to develop the strategy that ultimately led to a favorable settlement for the client.
Construction Law – Litigation/Arbitration/Dispute Resolution
- Analyzed whether client’s claim under performance bond was barred by bond conditions and drafted a complaint for breach of contract.
