Florida Construction Recovery Fund Claim Timeline Tracker

Use this tracker to monitor key dates and milestones from the moment a dispute arises to final claim submission.

Phase 1: Contractor Dispute

Initial Contractor Dispute Identified: Contractor abandonment or misconduct begins		Must be documented (e.g., >90 days of inactivity)
Document the final attempt to resolve dispute with contractor		Include emails, calls, or demand letters

Phase 2: Legal Action

Task	Date of Event	Notes
Initiate Formal Legal Proceedings Against Contractor		Must be based on Fla. Stat. §489.129 violations
Receive final judgment or restitution order		This starts the 1-year claim clock
Begin asset search		Required for claim eligibility to prove reasonable efforts have been made to determine whether the contractor possesses any assets with which to satisfy the underlying judgment, and that no such assets have been identified.
Prepare and Submit Affidavit of Diligent Asset Search		This form documents efforts to locate assets belonging to the contractor.  Use the DBPR short or long form.

Phase 3: Claim Preparation

Compile Contractual and Financial Documentation Supporting Claim		Gather contract, invoices, and payment records. Must show financial loss
Collect photos and inspection reports		Document damage or incomplete work
Prepare and Execute Proof of Loss Affidavit		Include amount of loss, cause of loss, and mitigation efforts.
Complete DBPR Claim Form		Available on myfloridalicense.com
Assemble submission packet		Include cover letter and checklist

Phase 4: Submission & Follow-Up

Mail claim to DBPR		Must be within 1 year of judgment
