Overview

Alek Maiberger, an active member of the Florida Bar, is an experienced litigator practicing in the areas of commercial litigation, real estate and construction law, and community association law. Prior to joining Jimerson Birr, Alek gained years of experience practicing community association law.   

In addition, Alek has extensive in-house experience representing organizations, including a Fortune 500 company, a global information technology provider, and a large healthcare system. In those roles, he gained experience in a wide range of transactional matters, including employment agreements, sales agreements, confidentiality, and privacy, among many others.  His prior experience involved obtaining recognition of exemption under Section 501(c)(3) of the Internal Revenue Code for a health care system’s preexisting children’s hospital. 

Alek was born and raised in Dayton, Ohio.  He attended Ohio State University, where he earned a Bachelor of Science in Education and a Business Minor, receiving Magna Cum Laude honors. After graduating from Ohio State, Alek moved to Jacksonville, Florida, and attended law school at Florida Coastal School of Law, receiving Cum Laude honors.   

When Alek is not doing what he loves most in life, spending time with his wife and two kids, he enjoys golfing, watching all sports, and listening to music.

  • Representative Matters

    Community Association Law 

    • Interpret and implement associations’ governing documents, including articles of incorporation, bylaws, and declarations.  
    • Enforce covenant and assessment collections violations in accordance with Florida statute and the association’s governing documents from lawsuit initiation through resolution.  
    • Draft and review associations’ vendor agreements, including, but are not limited to, renewing services (e.g., landscaping contracts) as well as finite or single service agreements (e.g., roofing contracts).  
    • Mediate disputes between the associations’ board of directors and owners.  
    • Obtain and draft land use and easement agreements.  
    • Represent hard money lenders focusing extensively on mortgage document preparation (e.g., security instruments and mortgage notes) as well as due diligence ensuring state and federal compliance (Truth in Lending Act) regarding residential and commercial loans.  
    • Ensure protection for the hard money lenders by working with title agencies to review title commitments and title insurance and pursuing title claims, if necessary.  
    • Lead residential and commercial mortgage defaults from lawsuit initiation through foreclosure and sale.  
    • Manage staff in assisting with the day-to-day operations such as billing, invoicing, tracking and statutorily required notices.  
    • Head the firm’s new marketing task force and its efforts, along with all legal requirements, to ensure efficacy and compliance with Florida Bar rules.  

    In-House Counsel

    • Reviewed a high volume of documents, including but not limited to customer-facing agreements offering the sale of PCM’s services, product offerings, software, and consulting services, confidentiality agreements, customers’ internal business and legal policies, partner and subcontractor agreements, and vendor agreements.  
    • Prepared and reviewed a high volume of health system documents, including, but not limited to, the following types of agreements: exclusive provider; physician recruitment, physician employment and personal services; severance; managed care; construction; software, hardware, equipment purchase and licensing; sponsorship; leases; and NFL affiliation.  
    • Worked extensively with Medical Staff, Risk Management, Corporate Compliance, Audit Services, Public Relations, Human Resources, Information Services, Privacy, and outside counsel to address areas of legal, risk, or compliance concern.  
    • Responded to antitrust, Stark, Anti-Kickback, and tax-exempt issues, and led response to civil, criminal, and administrative subpoenas, investigatory demands, and court orders.  
    • Served as the legal representative for the Cultural Competence Committee and conducted education related to Section 1557, the nondiscrimination provision of the Affordable Care Act. 
    • Interpreted and provided guidance related to laws and regulations, including EMTALA, HIPAA, FIPA, the Baker Act, and advance directives.
