Overview

Ty Robare is a commercial litigation attorney at Jimerson Birr, where he represents businesses, lenders, and individuals in high-stakes disputes throughout Florida’s state and federal courts. His practice spans general commercial litigation, banking and financial services, creditors’ rights and judgment collection, consumer class action defense, construction and real estate litigation, business and ownership disputes, and eminent domain.

Mr. Robare joined Jimerson Birr as an associate in 2023, after spending the prior summer with the firm. Since then, he has built a litigation practice grounded in thorough preparation and a practical, business-minded approach to resolving disputes. He has defended companies against putative class actions under Florida’s telemarketing and consumer-protection statutes and in data-privacy and data-breach litigation. He has taken creditors’ rights and commercial-collection actions through judgment and post-judgment enforcement, represented owners, builders, and buyers in construction and real estate disputes, and secured compensation for property owners in eminent domain proceedings. He also counsels closely held companies and their owners through partnership disputes, ownership separations, and executive transitions. In every engagement, he works to give clients a clear read on their risk and a realistic path to the outcome they need.

Mr. Robare earned his Juris Doctor, cum laude, from the University of Florida Levin College of Law in 2023. He is a “Triple Gator,” having also earned a Master’s in International Business from the Hough Graduate School of Business and a Bachelor of Arts in Business Administration from the Warrington College of Business, each from the University of Florida. In law school, he was a founding member and Student Works Editor of the Florida Entertainment and Sports Law Review and held leadership roles in the Entertainment and Sports Law Society and the Student Bar Association.

Before law school, Mr. Robare’s interest in advocacy and leadership took shape through a series of formative experiences. He served as a regional director for his national fraternity’s headquarters, training and advising chapters across the country, and taught middle-school mathematics in Brooklyn, New York. Those experiences drew him toward a career in advocacy and client service.

A native of Sanford, Florida, Mr. Robare moved to Jacksonville following law school and lives there with his wife. Outside the office, they enjoy exploring the city’s restaurant scene, antiquing, and spending time at the beach with their Goldendoodle. He is also an avid traveler for live music, a film enthusiast, and a podcaster.

    Consumer Class Action & Data Privacy Defense

    • Defended a consumer-products company in a putative class action under the Florida Telephone Solicitation Act challenging its text-message and telephone marketing practices, achieving an early, confidential resolution and dismissal with prejudice.
    • Defended a roofing and home-improvement contractor against a putative statewide class action under the Florida Telephone Solicitation Act alleging non-consented marketing text messages, developing a defense focused on standing and class-certification deficiencies.
    • Defended a telehealth company in a putative consumer-privacy class action alleging unlawful website-tracking interception of patient information, moving to compel arbitration and securing a voluntary dismissal of the plaintiff’s claims.
    • Defended a diagnostic medical-imaging provider in a consolidated consumer data-breach class action involving compromised patient information, moving to dismiss and negotiating a court-approved, class-wide settlement.

    Eminent Domain & Property Rights

    • Represented multiple property owners in partial-taking condemnation proceedings arising from a municipal road-widening and improvement project, negotiating compensation for the land acquired, affected site improvements, and severance and cost-to-cure damages to the remaining property.
    • Represented a landowner in a state transportation authority’s condemnation of a construction easement for a state road project, obtaining a stipulated final judgment awarding compensation above the condemnor’s initial good-faith estimate, with the owner’s attorneys’ fees and costs paid by the condemning authority under Florida’s eminent domain statutes.
    • Represented property owners in a state highway right-of-way taking, resolving the compensation dispute at mediation and coordinating disbursement of the award between the owners and their mortgage lender.
    • Represents property owners, including homeowners, in eminent domain matters arising from road-widening, right-of-way, and construction-easement takings by municipal and state transportation authorities, focusing on maximizing compensation for the property taken, affected improvements, and severance damages.

    Creditors’ Rights, Collections & Commercial Litigation

    • Represented the seller of a food-service business as a secured creditor enforcing a defaulted, seller-financed promissory note, obtaining a final judgment for the full accelerated balance, interest, attorneys’ fees, and costs.
    • Prosecuted commercial-collection actions for a wholesale building-materials distributor against defaulting contractor customers, including obtaining substituted service on an administratively dissolved debtor and securing final default judgments for post-judgment enforcement.
    • Represented a digital-marketing agency in a contract and fee-collection dispute against a customer who defaulted on a minimum-commitment advertising-management agreement, pursuing the balance due through demand and contractual arbitration.
    • Defended a managed office-technology services company against a vendor’s six-figure account and breach-of-contract claim and prosecuted affirmative counterclaims, securing a favorable settlement after moving for partial summary judgment to strike duplicative billing.

    Construction & Real Estate

    • Represented the sellers of a residential-construction business in a multi-party dispute arising from a business asset sale, pursuing indemnity, breach-of-contract, and defamation claims and negotiating confidential settlements that resolved related homeowner construction claims.
    • Defended a residential homebuilder against a homeowner’s construction-defect and non-disclosure suit involving alleged latent defects in a newly constructed home, securing a confidential settlement and dismissal with prejudice.
    • Represented the majority partner of a family real-estate partnership in a quiet-title, declaratory-judgment, and specific-performance action enforcing a partnership tax-default provision, obtaining judgments that quieted title to multiple parcels and resolving a competing statutory partnership-interest buyout demand.

    Business, Ownership & Employment

    • Represented departing members and managers of a closely held Florida company in an amicable ownership separation, documenting their withdrawal from management and negotiating confidentiality agreements to protect the company’s proprietary information.
    • Advised a senior corporate executive in negotiating and documenting a separation and severance package with a national consumer-products manufacturer, addressing severance pay, equity, restrictive covenants, and release terms.

Jimerson Birr
