This Privacy Policy applies to Jimerson Birr, P.A. (“Jimerson Birr,” “we,” “us”) and to the following websites it operates:

• jimersonfirm.com, the firm’s primary website.
• lawsuitdefense.com, a Jimerson Birr website for business litigation defense inquiries.

Information We Collect

Across these sites we collect information you submit through a web form, such as your name, email address, telephone number, company, title, the state in which a lawsuit was filed, and a description of your situation. We also collect information your browser provides automatically, including IP address, cookie and device identifiers, device and browser type, the page that referred you, the pages you view, how you interact with a page, and approximate location inferred from IP address.

Categories of Personal Information, Sources, and Purposes

In the past 12 months we have collected the following categories of personal information, as those categories are described in the California Consumer Privacy Act:

• Identifiers, such as name, email address, telephone number, IP address, and cookie or device identifiers.
• Customer records, such as the contact details you include in a form or message.
• Professional or employment-related information, such as your company and title.
• Internet or other electronic network activity, such as pages viewed, referring pages, and how you interact with our pages, including mouse movement, scrolling, and clicks.
• Approximate geolocation inferred from IP address. We do not collect precise geolocation.
• Information you choose to include in the description of your situation. We do not ask for sensitive personal information through our websites, and we do not use or disclose sensitive personal information to infer characteristics about you.

We collect this information directly from you, automatically from your browser or device, and from the analytics and advertising providers listed below. We use it to respond to your inquiry, check for conflicts of interest, communicate with you, operate and secure our websites, understand how our websites are used, show you Jimerson Birr advertising, and meet our legal, ethical, and professional obligations.

We disclose personal information for these business purposes to service providers that support our operations, including website hosting and security providers, form processing providers, our client intake and case management system, email delivery providers, and the analytics providers listed below.

• Gravity Forms: processes contact form submissions, which are stored on the site and delivered to the firm.

• AddToAny: social sharing buttons.
• WP Engine (WPEngine, Inc.): website hosting.

• AdRoll (NextRoll, Inc.): advertising and retargeting, so we can show Jimerson Birr advertising to you on other websites.
• LinkedIn Insight Tag (LinkedIn Corporation): advertising measurement and audiences.
• Akismet (Automattic Inc.): spam filtering. Submission content and IP address are sent to Automattic for evaluation.
• MailPoet: email delivery and subscriber management.
• WordPress.com (Automattic Inc.): website hosting.

Advertising and Your Choices

We use advertising cookies and pixels so that Jimerson Birr advertising can be shown to you on other websites and social media platforms. We do not sell your personal information for money. Depending on where you live, the use of these tools may be treated as “targeted advertising,” or as a “sale” or “sharing” of personal information, under applicable state law, and you may have the right to opt out.

Personal information sold or shared in the past 12 months. In the past 12 months we have made identifiers (such as IP address and cookie or device identifiers) and internet or other electronic network activity available to advertising and analytics providers, which California law may treat as a “sale” or “sharing” for cross-context behavioral advertising. The categories of third parties involved were advertising networks and analytics providers: Google, Microsoft (Clarity), AdRoll and its partner ad networks, and LinkedIn. During part of that period jimersonfirm.com also used ShareThis (sharing buttons) and SalesLoft (engagement tracking); both were removed in October 2026.

You can opt out by using the opt-out link on the site you are visiting (for JimersonFirm.com, our Your Privacy Choices page), by adjusting your browser’s cookie settings or enabling a Global Privacy Control signal, or by contacting us using the details below. You may also opt out of interest-based advertising industry-wide at optout.aboutads.info and optout.networkadvertising.org.

Advertising and LawsuitDefense.com. On LawsuitDefense.com we use advertising cookies and similar tools from Google, LinkedIn and AdRoll to measure our ads and show them to visitors on other websites. California law may treat this as “sharing” personal information for cross-context behavioral advertising. You can opt out at any time on our Your Privacy Choices page. We also treat a Global Privacy Control signal from your browser as an opt-out.

AdRoll works with partner ad networks and data providers, which may include Experian, LiveRamp, Tapad, Bombora, The Trade Desk, PubMatic, Magnite, Index Exchange, OpenX, Outbrain, Taboola, TripleLift, and Xandr, to recognize your browser across websites and show our ads.

Customer lists. We may upload contact information that clients and former clients have provided to us, such as email addresses and phone numbers, to advertising platforms such as Google, in hashed form where available, so that the platform can match it to its own users. We use this to exclude current clients from our advertising and to measure our ads. We do not use information about a client’s legal matter for advertising. To ask that your information not be used this way, email [email protected] with the subject “Privacy Request.”

Cookies and Consent

Most browsers let you refuse or delete cookies through their settings. Blocking analytics or advertising cookies will not prevent you from using these sites or from contacting us. If your browser is set to Pacific time, both sites ask for your consent before any advertising cookies are set, and they stay off unless you choose Accept. Visitors located in the European Economic Area, the United Kingdom, and Switzerland are asked for consent before analytics and advertising cookies are set.

How Long We Keep Information

As a law firm, we keep certain records for long periods so that we can meet our legal, ethical, and professional obligations, including identifying conflicts of interest and responding to claims. We use the following criteria to decide how long we keep each category of information:

• Website inquiries and form submissions, conflict check records (the names of prospective clients and other parties), and information about clients and matters: kept at least until all applicable statutes of limitations have expired, and in practice generally kept indefinitely, because these records are needed to identify conflicts of interest and to meet our professional obligations.
• Email and text message preferences, including records of opt-ins and opt-outs: kept indefinitely so that we continue to honor your choices.
• Website analytics data: Google Analytics keeps user-level and event-level data for 14 months. Microsoft Clarity keeps session playback data for 30 days and heatmap data for up to 9 months.
• Advertising cookie data held by advertising providers: kept according to each provider’s own retention practices. Cookies on your browser expire or can be deleted through your browser settings.

Text Messages

If you opt in to receive text messages from Jimerson Birr, P.A., we use your mobile number only to send the messages you agreed to receive. We do not sell, rent, or share your mobile number or your text message opt-in consent with third parties or affiliates for their marketing or promotional purposes. We may share it only with service providers that send messages on our behalf. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help.

Your Privacy Rights

Depending on where you live, including if you are a California resident, you may have the right to:

• Know the categories of personal information we have collected about you, the categories of sources, our business or commercial purposes, the categories of third parties to whom we disclose it, and the specific pieces of personal information we hold about you.
• Delete personal information we collected from you, subject to legal exceptions.
• Correct inaccurate personal information.
• Opt out of the sale or sharing of your personal information and of targeted advertising.

Non-discrimination. We will not deny you services, charge you a different price, provide a different level or quality of service, or otherwise discriminate against you for exercising any of these rights.

How to Make a Request

You can submit a request by emailing [email protected] with “Privacy Request” in the subject line, or by calling us toll-free at 1-888-884-6416. To opt out of the sale or sharing of your personal information, you can also use our Your Privacy Choices page or a Global Privacy Control signal.

Before acting on a request to know, delete, or correct, we will verify your identity by matching information you provide with information we already hold. We may ask for more information for requests involving specific pieces of personal information. We do not require verification for opt-out requests. We aim to respond within 45 days, and if we need more time we will tell you why and may take up to an additional 45 days. Some information must be retained where a professional, ethical, or legal obligation requires it, including obligations owed to current and former clients.

Authorized agents. You may use an authorized agent to make a request on your behalf. We will ask the agent for signed written permission from you, and we may ask you to verify your identity directly with us or to confirm that you gave the agent permission, unless the agent holds a valid power of attorney.

No Attorney-Client Relationship

Submitting information through either site does not create an attorney-client relationship and does not make the information privileged or confidential. An attorney-client relationship is formed only when we agree in writing to represent you. Please do not send sensitive or time-critical information through a web form.

Children

These sites are directed to businesses and are not intended for children. We do not knowingly collect personal information from children under 13, and we do not sell or share the personal information of consumers we know to be under 16.

We may update this Policy. The date below indicates when it was last revised.
