Overview

Gustavo “Gus” Sardina is a seasoned commercial litigator navigating business disputes, intellectual property matters, and complex transactions. He primarily represents small and medium sized businesses in high-stakes litigation, focusing on contract claims, real estate disputes, and trademark enforcement. Clients turn to Gus for clear guidance, decisive strategy, and a steady hand. Gus’s core focus is on delivering practical, results-driven counsel.

Gus’s litigation practice includes trial and appellate work in state and federal court, proceedings before the USPTO and Trademark’s Trademark Trial and Appeal Board, and mediation and pre-suit resolution. He frequently represents clients in heavily regulated industries such as tobacco and international trade, where legal disputes intersect with government oversight and brand protection concerns and often involve cross-border claims and complex jurisdictional issues.

In addition to an active litigation practice, Gus has considerable experience with transactional matters including providing trademark clearance opinions, filing and prosecuting trademark applications before the USPTO, assisting clients with business formation and shareholder/operating agreements, representing clients with real estate and commercial transactions, and advising clients on the full life cycle of their businesses – from formation to exit.

Before joining Jimerson Birr, Gus practiced in Miami, where he led business litigation matters involving multimillion-dollar disputes, cross-border claims, and IP enforcement. Gus also served as in-house counsel to a real estate holding company managing approximately one million square feet of grocery-anchored commercial properties with representations including developing a multi-jurisdictional litigation strategy across three Florida counties and Delaware Bankruptcy Court that led to the renegotiation of three leases with a regional grocer to the substantial advantage of his client.

Fluent in Spanish, Gus often works with bilingual teams and cross-border clients. He lives in Valdosta, Georgia with his wife and two young children, and serves on the board of the South Central Georgia chapter of the American Red Cross. Outside of work, Gus enjoys being outdoors, the occasional overnight camping trip, and spending time with his family.

  • Representative Matters

    Trademark

      • Obtained dismissal of an interpleader action and release of funds held for the client’s benefit in less than three weeks from being retained.
      • Successfully obtained dismissal with prejudice for two individual defendants in a multi-party fraud and civil theft action, ending the case against them without payment or further proceedings.
      • Successfully represented a mom-and-pop cigar brand owner in a trademark infringement action against a Fortune 500 tobacco company resulting in a highly favorable purchase of the disputed brand by the defendant.
      • Obtained preliminary injunctive relief in a trade dress claim litigated before the Southern District of Florida.
      • Obtained judgment of cancellation of a trademark registration before the TTAB in favor of a client with prior common law rights to a confusingly similar trademark.
      • Obtained injunctive relief in a copyright infringement action in favor of client in the Middle District of Florida.
      • Represented clients in connection with over 1,000 United States trademark applications and registrations.
      • Managed the domestic and international trademark portfolio of a multinational cigar company manufacturing approximately 1 billion sticks per year with a presence in approximately 100 countries, including overseeing all aspects of portfolio management and enforcement.

    Business and Real Estate Litigation

    • Obtained summary judgment, affirmed by the Third District Court of Appeal, and entitlement to fees based on an offer of judgment in favor of the buyer in a cancelled real estate transaction after the seller sued for damages as a result of termination of the contract.
    • Obtained summary judgement of ejectment in favor of a landlord against a holdover subtenant after the primary tenant abandoned the tenancy.
    • Obtained dismissal with prejudice of an ADA website claim in favor of a retail client.
    • Represented real estate investors in post-mortgage and auction acquisition writ of possession, ejectment, and bankruptcy proceedings to secure their property rights.
    • Obtained dismissal of a multi-count shareholder derivative action alleging fraud, conversion, and breach of duty of loyalty against the company’s manager.
    • Defeated motion to dismiss for lack of personal jurisdiction in a complex, multi-state, multi-party litigation allowing for the entire action to be heard in a single jurisdiction, which lead to favorable settlement with all parties in a single venue.

    Transactional and Non-Litigation

    • Represented a multinational cigar company with a presence in approximately 100 countries in a variety of matters from compliance with European Union TPD2 regulations, management of agreements with distributors in every jurisdiction in which the client’s products were offered, and domestic regulatory strategy.
    • Oversaw leasing, tenant relations, and legal matters for a 1 million sq. ft. portfolio of grocery-anchored shopping centers with approximately 300 commercial tenants across Florida.
    • Assisted numerous small and medium sized businesses with corporate formation and structuring including preparation of operating agreements, transfer of shares, restructuring, sales, and dissolutions.
