Overview

Grace Roberts is an attorney at Jimerson Birr, P.A., where she began as a law clerk in the fall of 2024. Since joining the firm, Ms. Roberts’ practice has grown to include a variety of legal areas, including community associations, construction, landlord/tenant disputes, and commercial arbitration. She is passionate about developing long-term relationships with clients and assisting them in a wide range of matters.

Ms. Roberts graduated from the University of Michigan in 2022, the same year she began her law school career at the University of North Carolina. As a law student, Ms. Roberts served as the president of the Sports and Entertainment Law Association, the treasurer of the American Constitution Society, and the top oral advocate on North Carolina’s Moot Court team.

During the summer after her 1L year at North Carolina, Ms. Roberts was a summer associate at Orr | Cook in Ponte Vedra Beach, Florida. In her second summer of law school, she worked as a summer associate at an environmental law firm in Raleigh, North Carolina. Prior to entering the legal field, Ms. Roberts worked as a substitute teacher, a tutor for Detroit Public Schools, and a barista.

Ms. Roberts was born and raised in South Portland, Maine, and she attributes much of her dedication and steadfast commitment to representing clients to her New England roots. In addition to law, Ms. Roberts is passionate about sports, especially her hometown teams in New England, the North Carolina Tar Heels, and the Michigan Wolverines. Outside the office, she can regularly be found fishing off the Jacksonville coast or exploring the local restaurant scene with her friends and her fiancé, Nick.

- Successfully opposed an emergency appellate stay, enabling enforcement of a garnishment judgment exceeding $555,000.
- Successfully defended property owners against a petition for writ of certiorari seeking to halt construction-defect litigation.
- Successfully obtained dismissal of an appeal challenging foreclosure judgment, preserving the judgment and allowing foreclosure proceedings to resume.
- Represented lenders, judgment creditors, and community associations in appeals involving foreclosure, judgment enforcement, fraudulent asset conversion, service of process, and attorneys’ fees.
Construction Litigation and Payment Disputes
- Represented property owners in construction and renovation disputes involving defective and incomplete work, unlicensed contracting, permitting, and claims against contractors and design professionals.
- Pursued recovery of payments made to unlicensed contractors and challenged the enforceability of construction agreements.
- Represented contractors in construction-lien foreclosure, unjust-enrichment, and other payment disputes.
- Represented a contractor in asserting payment-bond rights arising from unpaid construction work.
- Handled contested construction litigation involving presuit requirements, expert testimony, and spoliation.
Creditors’ Rights, Bankruptcy, and Judgment Enforcement
- Represented a judgment creditor in enforcement proceedings arising from a judgment exceeding $5 million, including garnishment, proceedings supplementary, fraudulent asset conversion, and contested exemption claims.
- Helped secure and enforce a garnishment judgment exceeding $555,000 in litigation involving interstate asset transfers and disputed homestead and tenancy-by-the-entireties protections.
- Represented businesses in bankruptcy adversary proceedings involving contractual obligations, promissory notes, counterclaims, and disputed creditor claims.
- Represented secured creditors and community associations in bankruptcy proceedings involving proofs of claim, claim objections, and related foreclosure and collection litigation.
- Pursued post-judgment remedies against judgment debtors and additional entities through proceedings supplementary and related enforcement litigation.
Commercial and Business Litigation
- Represented businesses and individuals in commercial disputes involving contracts, personal guaranties, fraud, civil conspiracy, and other business torts.
- Represented a commercial supplier in litigation seeking recovery of more than $590,000 from a purchaser and personal guarantor.
- Represented franchising businesses and individuals in multiparty disputes involving franchise agreements, fraud, tortious interference, arbitration, and forum-selection provisions.
- Served on the litigation team that successfully invalidated a sister-state default judgment exceeding $225,000 and obtained an injunction against its rerecording in Florida.
