Curtis Campbell

Overview

Curtis L. Campbell focuses his practice on complex commercial disputes, creditors’ rights, and distressed-business matters in which financial instability, insolvency, or breakdowns in ownership and control threaten enterprise value. He represents businesses, financial institutions, private lenders, investors, fiduciaries, judgment creditors, contractors, and other stakeholders in high-stakes litigation involving commercial loan enforcement, bankruptcy, Assignments for the Benefit of Creditors, receiverships, post-judgment collection, fraudulent transfers, and related asset-recovery issues.

Curtis is frequently engaged when early intervention and strategic litigation are necessary to preserve assets, protect collateral, stabilize business operations, or create leverage toward a negotiated resolution, restructuring, or orderly wind-down. His work includes pursuing and defending emergency injunctive relief, enforcing judgments and security interests, conducting proceedings supplementary, litigating contested bankruptcy matters, and advising creditors on how to protect their rights before and after a borrower or counterparty becomes insolvent.

In addition to his distressed-business and creditor-enforcement practice, Curtis has significant experience litigating complex commercial matters in state and federal courts and in arbitration. His matters involve contract disputes, business torts, construction claims, franchise relationships, restrictive covenants, shareholder and ownership disputes, insurance coverage, and disputes arising from acquisitions and other commercial transactions. Curtis approaches each matter with an emphasis on identifying the client’s practical business objective, developing leverage early, and pursuing a strategy that accounts for both the legal issues and the economics of the dispute.

Curtis’s prior insurance coverage experience includes representing businesses seeking coverage for COVID-19–related losses and participating in the landmark multidistrict litigation, In re: Society Insurance Company COVID-19 Business Interruption Insurance Coverage Litigation, MDL No. 2964. That experience continues to inform his work evaluating insurance policies and other potential sources of recovery in distressed, insolvency, and post-bankruptcy matters.

Curtis also has experience handling transactional and advisory matters supporting business operations, acquisitions, and investments. His work has included drafting corporate governance documents, letters of intent, memoranda of understanding, settlement agreements, and real estate contracts, as well as conducting legal and regulatory due diligence. He has assisted with transactions involving multistate assets, including the acquisition of a multi-use property in New York and the acquisition of a Florida-based company by a publicly traded corporation.

Within the firm, Curtis serves in a leadership role overseeing and mentoring attorneys and legal professionals handling commercial litigation, creditors’ rights, and insolvency-related matters. He is admitted to practice in Florida, Georgia, New York, Tennessee, and Texas and represents clients in state and federal proceedings across multiple jurisdictions.

Curtis also serves as the moot court coach at Jacksonville University College of Law. During law school, he earned Top Brief honors at the Emory National Civil Rights and Liberties Moot Court Competition in consecutive years and served as President of the Legal Aid Society.

Originally from Nashville, Tennessee, Curtis earned his Bachelor of Science in Economics from Middle Tennessee State University, where he served as vice president of the mock trial team and competed at the national level. Outside of his practice, Curtis enjoys golf, hiking with his family, reading, and working on writing projects.

- Successfully defended an international manufacturing corporation in a stream-of-commerce action involving multiple fatalities through motion practice.
- Handled catastrophic, multiparty commercial litigation arising from a factory incident involving employee fatalities and resolved the matter at mediation for an amount substantially below the client’s anticipated exposure.
- Handled class action litigation involving automobile-glass claims and the employment classification of insurance agents.
- Litigated claims against broker-dealers arising from allegedly fraudulent recommendations concerning bond investments.
Insurance Coverage and Recovery
- Analyzed coverage issues for national insurance carriers involving commercial general liability, contractors’ pollution liability, businessowners, umbrella, life, health, professional liability, and limited service and repair policies in more than thirty states.
- Participated in federal multidistrict litigation addressing whether businesses were entitled to insurance coverage for COVID-19-related business interruption losses.
- Advised national insurance carriers regarding developments in insurance law and the potential impact of judicial and regulatory decisions.
- Assisted with drafting and revising insurance policy language to clearly express the intended coverage and comply with applicable state and federal law.
